Financial up gradation under MACP III for PAs


In pursuance of the orders contained in DG’s (Establishment division) New Delhi O.M. No. 4-7/(MACPS)/2009-PCC dated 18.09.2009 communicated in Chief PMG Tamilnadu Circle, Chennai letter no. ESB/ 300-ACP/2009 dated 23.09.2009, clarification issued in Dte letter no. 4-7/ (MACPS)/2009-PCC dated 19.12.2009 communicated in Chief PMG Tamilnadu Circle, Chennai letter no. ESB/ 300-ACP/2009 dated 01.01.2010, approval of the competent authority is hereby conveyed for financial up gradation under Modified Assured Career Progression Scheme III for the following officials and these officials are placed in the next higher grade pay, as applicable to each individual as per the existing orders in force, and with effect from the date noted against each:

The financial upgradation granted above under MACPS is subject to the following conditions that:

1.    The official should have completed 10 years of qualifying service in the same grade pay or
      30 years of qualifying service from the entry grade.

2.    The official shall exercise an option under FR 22(1)(a)(1)  to get his/her pay fixed in the higher post/grade pay either from the date of financial upgradation or from the date of their next increment. The pay and date of increment would be fixed in accordance with clarification no.2 of Department of Expenditure’s O.M. No. 1/1/2008-10 dated 13.09.2008. The option in this regard should be exercised within one month from the date of issue of these orders. Option once exercised is final.

3.    Benefit of pay fixation available at the time of regular promotion shall be allowed at the time of financial upgradation under the scheme. No further fixation of pay at the time of regular promotion shall be available, if it is in the same grade pay as granted under MACPS. However, at the time of actual promotion if it happens to be in a post carrying higher grade pay than what is available under MACPS, no pay fixation would be available and only difference of grade pay would be made available.

4.    On grant of financial upgradation under the scheme, there shall be no change in the designation, classification or higher status.

5.    No reservation orders/roster shall apply to the MACPS scheme, as the scheme contemplates merely placement in the immediate higher grade pay on personal basis and shall not amount to functional promotion of the employees concerned.

6.    Financial upgradation ordered above shall be purely personal to the individual employees concerned and shall have no relevance to their seniority position. No stepping up of pay in the pay band or grade pay would be admissible with regard to junior getting more pay than the senior on account of pay fixation under MACP Scheme.

7.    In the matter of disciplinary/penalty proceedings, grant of benefit under the MACPS shall be subject to rules governing normal promotion. Such cases shall, therefore, be regulated under the provisions of the CCS (CCA) Rules, 1965 and instructions issued thereunder.

8.     Grant of higher pay scale/Grade pay under the MACPS shall be conditional to the fact that they, while accepting the said benefits shall be deemed to have given their acceptance for regular promotion on occurrence of vacancies subsequently. Refusal to accept the higher post on regular promotion subsequently shall be liable for normal debarment of the concerned officials, for regular promotion as prescribed in the general instructions in this regard.

9.    The officials placed in the next higher pay scale/grade pay will continue to perform the duties assigned to their posts to which they are attached at present, unless any specific instructions/orders are issued subsequently in this regard.

10.   If at a later date, it is found that any official is not eligible for financial upgradation from the date from which it has been given, these orders are liable to be modified /cancelled and no other separate notice will be issued in this regard. Further if any excess payment is made it will be recovered and no separate notice will be issued.  Undertaking   to this effect  should  be obtained from the officials before effecting payment and kept on record. 

11.  In the case of official for whom any punishment affecting their pay like stoppage of increment or           reduction in pay is current the up gradation should be given effect only on expiry of penalty.
